The Council's in house legal service deals with licensing. Our main functions concerning licensing include:
Moray Licensing Board - Liquor Licensing
Each Local Authority in Scotland is required to appoint a licensing board for the administration of licensing with respect to the sale and supply of alcohol liquor. The Licensing Board meet quarterly in January, March, June and October. A licensing board can also hold an adjourned meeting within a month of the quarterly meeting. All licensing board meetings are held in public.
Three weeks prior to the Board Meeting, once all the Applications are received a further advert appears in the Northern Scot
which details all applications for New Licences and Regular Extensions of Permitted Hours. This advert also details how to

The Moray Licensing Board issued guidelines after detailed consultation with the licensed trade, Grampian Police, Grampian
Fire Brigade and the Environmental Health, Planning and Building Control departments of the Council in May 1999. These were
updated and approved in July 2001. Copies of the guidelines can be obtained from our office. If you have any queries, we will

Statement of Policy for the Licensing (Scotland) Act 2005
Section 6 of the Licensing (Scotland) Act 2005 requires every Licensing Board to publish a statement of policy each three years. This policy came into effect in November 2007 and will continue in effect until November 2010.
The Moray Licensing Board is a public authority and has specific duties under various pieces of legislation to prepare and publish equality schemes in respect of race, disability and gender:

Under the Civic Government (Scotland) Act 1982 each Local Authority in Scotland is given the option of Licensing a number
of different activities if they occur within their area, for example Taxi's, Window-Cleaners, Public Charitable Collections
etc..
We process applications for all Licences. Application forms for these can be obtained from us and once completed should be returned to our Office with the appropriate
fee. All application forms are accompanied by Guidance notes.
If you require an application form for a Street Trader's licence you should contact Environmental Services Department.
If objections or observations are received to a Licensing application, a Hearing is held before the Council Licensing Committee.
This Committee meets every 8 weeks.
