TRADE WASTE SERVICE AGREEMENT |
Conditions of Service:
1. Businesses wishing to use the Council’s Trade Waste Collection Service are required to lease a bin from the Council unless alternative arrangements are made by agreement. The standard agreement is for a period of one year, other periods may be negotiable but must be for a minimum of one month.
2. Charges will be based on the total capacity of waste passed to the Council for disposal.
3. Charges will be applied for delivery/removal of wheeled bins on the minimum leasing period.
4. Rental and service charges are payable quarterly/annually in advance. Details are given in the table below. Failure to settle any invoice timeously will result in the removal of the wheeled bin.
5. The Council will replace wheeled bins, which become unusable or faulty through fair wear and tear. The cost of replacement of the leased bins which are lost, stolen or damaged through misuse whilst under the lessee’s control, will be recovered from the lessee.
6. Any increase(s), reduction(s) or replacement of current taxes in or by other Government tax or levy will take immediate effect on occurrence and will be charged or refunded to the lessee.
7. Should The Moray Council waste disposal costs fluctuate in excess of 10% during the term of the lease, the uplift and disposal of the undernoted charges may be subject to review.
8. Any change in ownership or tenancy should be notified in writing within one month of that change.
9. The lessee shall use the bins for the disposal of non-hazardous waste only. Any wheeled bin with an open lid, due to the refuse within, will not be uplifted. No excess refuse (i.e. presented for collection outwith the bin) will be uplifted unless prior arrangements have been made. Trade Waste bins must be presented at the kerbside for collection, by 7.30 a.m. on the day of collection, unless prior arrangements have been made. The lessee shall maintain the bin in a hygienic and clean condition.
10. You are obliged to segregate cans, glass, paper and cardboard and use either the collection service provided or one of the Council’s Recycling Centres to deposit these materials. Residual waste bins must not contain paper, cardboard, glass or cans. Residual bins may not be emptied if these recyclates are found.
11. If the lessee misses a collection and wishes their waste to be uplifted prior to the following agreed collection day, there will be an additional service charge applied.
12. The collection of glass bottles is undertaken by a third party on behalf of the Council. The current charge for this service as from 1st April 2008 is £3.20 per week (£166.40 per annum).
13. Frequent, random inspections will be undertaken to ensure that waste is presented for collection in accordance with this agreement.
