Where are these Rights for Individuals?
The Act gives the following rights to people where the Council holds personal information about them. They have:
-
Subject access rights to personal data, held about them by the Council.
-
A right to prevent processing of personal information if it is causing or is likely to cause substantial damage or distress
to that individual (the "data subject")
-
A right related to automatic decision making. So if the Council uses technology
-
to reach a decision which is based solely on processing by some automatic means, say grants to individual applicants using
a specially designed computer programme, then the data subject can give written notice that he / she does not want to be subject
to purely automatic decision making procedures where those procedures might have some significant impact on that person
-
A right to have inaccurate personal information corrected or erased
-
A right to take action for compensation for damage
