General Information

Details of your rights and responsibilities are fully explained in your Scottish secure tenancy agreement.  Also, the Scottish Executive has published this  leaflet to help you.

Most of our tenants have a Scottish secure tenancy agreement.  This is a new type of tenancy created by the Housing (Scotland) Act 2001.

We will explain to you what your rights and responsibilities are when you sign your tenancy agreement.

What are your Responsibilities?

Your responsibilities, which are contained in your tenancy agreement, include the following:

• Use as your main home

• Members of your family

You are entitled to have members of your family living in the house with you, as long as this does not lead to overcrowding. When we ask, you must tell us who is living in the house. You must tell us as soon as there is any change in the people who are living in your house.

Your Rights

Your rights, which are contained in your tenancy agreement, include the following:

• You can have a joint tenancy with one or more people, as long as you get permission in writing from your Area Housing Officer.
• You may have the right to buy your home.
• You can assign (transfer) or sublet your house with our permission. Similarly, you can take in lodgers with our permission.
• You can get certain urgent repairs done quickly and at no cost to you under the ‘Right to repair’ scheme.
• You can carry out improvements to your home with our permission. In certain circumstances you may be entitled to compensation for these improvements.
• You can exchange your property for another, as long as you get permission in writing from your Area Housing Officer.
