Delegated Powers

 

Powers previously delegated are as follows:

a.         Applications for Occasional Licences and Permissions and Occasional Extensions of Permitted Hours

            Any two Members could grant these, but where Members were unwilling to sign they are required to consult with the Member of the Licensing Board nearest to the premises.

b.         Applications for Finalisation of Provisional Grant of Licence

            The Clerk or Depute Clerk could grant these applications and would advise the Chairman, Vice Chairman and the Member of the Licensing Board nearest to the premises in writing.

c.         Applications for Transfer of Licences to Executors, Judicial Factors etc.

            The Clerk or Depute Clerk was authorised to grant these provided there were no objections or observations from the Chief Constable or other competent objector.

d.         Applications for Substitution of a New Responsible Employee or Agent

            These occur where the licence has been granted jointly in name of a company, partnership etc and a responsible employee.

            The Clerk or Depute Clerk was authorised to grant these provided there were no objections or observations from the Chief Constable or other competent objector.

e.         Applications for Temporary Transfer of Licence

            The Clerk or Depute Clerk was authorised to grant these provided there were no objections or observations from the Chief Constable or other competent objector.

f.          Applications for Alterations

            The Clerk or Depute Clerk could grant these applications and would advise the Chairman, Vice Chairman and the Member of the Licensing Board nearest to the premises in writing.

g.         Reports from Clerks to Courts

i. Where a Report from a Clerk to a Court intimates that a Licensee within the jurisdiction of the Board has been convicted of an offence in terms of the Licensing Acts, the Clerk has been authorised, after consultation with the Chairman whom failing the Vice-Chairman, to cite the Licensee to appear at the next Meeting of the Board.

ii. Where a Licensee or a member of staff is convicted of any offence having a bearing on the running of licensed premises, such as an offence under the Weights and Measures Act 1988 the Clerk has been authorised, after consultation with the Chairman who failing the Vice-Chairman, to cite the Licensee and member of staff to appear at the next Meeting of the Board.

1.Gaming Machine Permits

In respect of applications for Gaming Machine Permits for Public Houses and Hotels in terms of Section 34 of the Gaming Act 1968, The Clerk or Depute Clerk was authorised to grant these where an application for Temporary Transfer of a Public House or Hotel Licence has been effected.
