Freedom of Information - Where we are not able to provide information

Although the Freedom of Information (Scotland) Act gives a general right of access to the public to all information the Council holds from January 2005, there are exemptions (see below). For most categories of exempt information the public interest will be considered when deciding whether to withhold or release it. The publications within the Scheme are highly detailed and these should not contain any exempt information, Each class of information within the Scheme will detail if it contains any exempt information - in these cases the information within the class will be made available with the exempt information deleted.

Under the Freedom of Information (Scotland) Act, the information below is exempt from disclosure:-

 

  • Where the information is already available elsewhere

 

  • Information concerning the conduct of criminal investigations and procedures

 

  • Law enforcement, including Council Tax and Non Domestic Rates collection

 

  • Where disclosure would endanger the health and safety of individuals

 

  • Environmental information available under separate legislation

 

  • Personal information covered by the Data Protection Act 1998

 

  • Where disclosure of information would breach a confidence actionable in the courts or breach legal professional privilege

 

  • Where information is a trade secret
