The Moray Council is part of the Scottish Governments Procurement Reform Programme. The McClelland Report on Procurement in the Scottish Public Sector instigated the Public Procurement Reform Programme, which began in 2007. The programme headed by John Swinney Cabinet Secretary for Finance and Sustainable Growth, aims to improve procurement across the Scottish public sector by implementing structures, capability and processes for continuous improvement, which deliver value for money improvements and support increased efficiency. All public sector bodies are required to support the initiatives that are a result of the programme.

Scotland Excel is the centre responsible for developing and implementing procurement strategies for the local authority Category B commodities. These are commodities that are common to all local authorities and Scotland Excel is using the buying power of all local authorities to drive costs down whilst improving efficiency. All joining authorities pay an annual fee dependant upon the population, which covers the operating costs of Scotland Excel.

Communication of changes in procurement at Moray Council has been issued to all suppliers through editions of the Suppliers Newsletter. To date these newsletters have covered the introduction of Scotland Excel and Public Contracts Scotland, the history behind the Public Procurement Reform Programme, the Suppliers Charter and the Single Point of Enquiry.

The Moray Council  has devolved procurement responsibility to Budget Managers in each department and whilst it has some service specific contracts in place there were no council wide contracts in place. The Corporate Procurement Team have responsibility for providing guidance; training, taking part in User Information groups before assessing and implementing all council wide contracts, issuing Supplier Newsletters and are part of the team introducing e-procurement across the Council. They will be working with all departments to develop commodity contracts for items not covered by Category A or Category B contracts.

Legislation dictates that all contract opportunities have to be administered in accordance with EU Directives which have been incorporated in the Public Contracts (Scotland) Act 2006. Essentially all contract opportunities for Part A

Services with a value of less than £156,000 have to be advertised on Public Contracts Scotland. All contract opportunities with a value of more than £156,000 have to be advertised in Public Contracts Scotland and the Official Journal of the European Union. This is to ensure we comply with Treaty requirements of non-discrimination, equal treatment and transparency. This advertising should enable different businesses to compete so that the contract could be awarded to the tenderer submitting the best bid.

Tender Process

If Moray Council have a requirement to purchase goods, services or works and the value of the purchase may exceed £30,000 within a 3 year period then the Council will go out to tender for this purchase.  Details of the tender process can be found here  A standard pre-qualifying questionnaire template can be found here.  A standard tender template can be found here

Advertising  of all contract opportunities is carried out on www.publiccontractsscotland.gov.uk. This is a free site and all suppliers to Moray Council that were previously registered with Public Tender were automatically transferred to this new site.
